Disclosure of your information

Unless specified otherwise in an agreement between you and Contigo in respect of Contigo’s provision of any software or services, we may share your personal information with:

  • Any member of our Energy One group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006;
  • Business partners, suppliers and sub-contractors where they are associated with the provision of services to you or otherwise as part of our performance of a contract with you (for example, Zendesk, who provide online customer support services, ZenQ, who provide test resource services and LiliCode Lab who provide software development services);
  • Analytics and search engine providers that assist us in the improvement and optimisation of our website, systems, software and services;
  • Third parties to whom we may choose to sell, transfer or merge parts of our/our subsidiaries’ business or assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy; and
  • Any party to which we are under a duty to disclose or share your personal data in order to comply with any legal obligation, to enforce or apply our terms of use,  terms and conditions or other agreement which you have entered into with Contigo and other agreements; or to protect the rights, property, or safety of Contigo, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

The data that we collect from you may be transferred to, and stored at, a destination outside the UK. It may also be processed by staff operating outside the UK who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. Whenever we transfer your personal data out of the UK, we will ensure that your data is treated securely and to a similar degree of protection by ensuring at least one of the following safeguards is implemented:

  • entering into a specific contract with the receiving party which is approved for use in the UK which gives personal data the same protection it has in the UK;
  • ensuring that the receiving party has approved binding corporate rules (requiring group companies to follow the same rules when processing your data); or
  • the receiving party is based in a country deemed to provide adequate protection to personal data by the European Commission.

All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website, systems, software and services you are responsible for keeping this password confidential. We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.
